These terms are the agreement between you and InstaWizard. By creating an account or using
the app you accept them. If you do not accept them, do not use the app.
Read this part even if you read nothing else. InstaWizard automates actions inside the
Instacart Shopper app. Instacart does not permit this. Using InstaWizard may cause your
Instacart account to be warned, suspended or permanently deactivated, and that may end your
ability to earn on that platform. You accept that risk yourself. We are not responsible for it.
1. What InstaWizard is
InstaWizard is an Android app that watches the Instacart Shopper batch screen using Android's
Accessibility Service and taps or swipes on your behalf when a batch matches filters you set. It
is a tool that operates your phone. It is not affiliated with, endorsed by, or connected to
Instacart, Maplebear Inc., or any delivery platform.
2. Your account
You must be at least 18 and legally able to enter this agreement.
One person per account. Do not share your login.
You are responsible for what happens under your account.
We may suspend or close an account that abuses the service, attempts to bypass payment,
or interferes with other users.
3. Deactivation, account loss, and your own risk
This is the most important term in this document, and it is the one people most often wish
they had read.
Automating the Instacart Shopper app is against Instacart's terms of service.
Instacart may detect it.
Instacart may warn you, suspend you, withhold earnings, or permanently deactivate your
account, at their discretion and without notice to us or to you.
You choose to take that risk. You use InstaWizard knowing this may happen.
We are not responsible for deactivation, suspension, lost batches, lost earnings, lost
bonuses, withheld pay, or the loss of your ability to work on any platform, whether or
not it was caused by using this app.
Deactivation is not grounds for a refund.
4. One account, one phone
Your account is locked to the first phone you sign in on. That is the device it
works on.
Accounts may not be shared. One person, one account, one phone. Do not give your
login to anyone else, and do not use anyone else's.
If your account is used on a different phone, it is automatically blocked and the
app stops working on every phone, including your own, until we unblock it. Blocking
is immediate and does not wait for us to review it.
Unblocking is done by us, by hand. Email
Instawizardbot@protonmail.com, tell us
what happened, and we will move your account to the new phone if the explanation is a
reasonable one — a replaced or repaired handset, for example.
We may refuse to unblock an account we believe is being shared, and we may close it. Time
lost while blocked is not refunded and does not extend your subscription.
5. What we do not promise
The app is provided "as is" and "as available", with no warranties of any kind, express
or implied, including any implied warranty of merchantability, fitness for a particular purpose,
or non-infringement.
We do not promise the app will catch any batch, any number of batches, or any amount of
earnings.
We do not promise it will work without interruption or error.
Instacart can change its app at any time and stop ours from working. We may or may not be
able to fix it, and how long that takes is not guaranteed.
Android and phone manufacturers may stop background apps, disable accessibility services,
or otherwise interfere with the app.
Nothing said in chat, on a call, in a video, or in any message is a promise or a warranty.
6. Limitation of liability
To the fullest extent the law allows:
We are not liable for any indirect, incidental, special, consequential, exemplary or
punitive damages, or for lost profits, lost earnings, lost opportunity, lost data, or
damage to reputation, arising from or connected to the app — even if we were told such
damage was possible.
Our total liability to you, for any and all claims combined, is limited to the amount you
actually paid us in the three months before the event giving rise to the claim, or
US$50, whichever is less.
This limit applies however the claim is framed — contract, negligence, strict liability,
or anything else.
Some jurisdictions do not allow certain exclusions of warranty or liability. Where that is
the case, the exclusions above apply only as far as that jurisdiction permits, and the rest of
these terms still stand.
7. You cover us
You agree to indemnify, defend and hold harmless InstaWizard, its owner, and anyone working
on it, from any claim, demand, loss, liability, damages, fine, penalty, or cost — including
reasonable legal fees — arising from or related to:
your use of the app;
your breach of these terms;
your breach of any other party's terms, including Instacart's;
your breach of any law or of anyone else's rights;
any claim brought against us by a platform, employer, or third party because of your use
of the app.
8. Payment
Access is sold as a recurring subscription, billed through Whop. Whop handles the
payment; we never see or store your card details.
The price is whatever is shown at checkout when you subscribe.
It renews automatically until you cancel. Cancel through Whop.
Cancelling stops future charges. It does not refund the current period.
Payments are non-refundable, including where your Instacart account is deactivated,
where Instacart changes its app, or where you simply stop using ours — except where a
refund is required by law.
We may change the price with notice. Continuing to pay after a change accepts it.
9. Acceptable use
Do not resell, rent, share or redistribute the app or your access to it, and do not share your account (see section 4). Do not reverse
engineer, decompile or tamper with it. Do not use it to harm, defraud or harass anyone. Do not
try to bypass the subscription or interfere with our servers.
10. Ending this agreement
You can stop at any time by cancelling and uninstalling. We can suspend or end your access at
any time, with or without notice, if you break these terms or if we stop offering the service.
Sections 3, 5, 6, 7 and 12 survive the end of this agreement.
11. Changes
We may update these terms. The date at the top shows when they last changed. Continuing to
use the app after a change means you accept the updated terms.
12. Law and disputes
These terms are governed by the laws of the State of New York, without regard to
conflict-of-law rules. Any dispute will be brought in the state or federal courts located in
New York State, and you agree to that venue. Any claim must be brought within one year
of the event giving rise to it, or it is permanently barred.
